Brigadier General Stephens was the chief judge of a panel of five presiding over the trial of Confederate General Clarence Potter for war crimes. He reluctantly pronounced Potter not guilty and stated that the panel could not, in justice, convict Potter for something that the U.S. had also done, namely carrying out military operations while wearing the uniform of the opposing side.
